Medical Services In Custody and Sexual Offence Examination
1.1 The Police and Crime Commissioner for Nottinghamshire wishes to
undertake a compliant EU tender exercise to establish a regional Framework
Agreement for the purchase of Medical Services in Custody and Sexual Offence
Examination for a period of 4 years (for all Lots) from 1st June 2016. The primary requirement is for Nottinghamshire Police and its specific delivery models are included within lots 1-3.
Other named forces within the East Midlands may choose to use the Framework Agreement in the future. and award call-off contracts via mini-competition under lots 4-6. In respect of lots 1-3 the Police and Crime Commissioner for Nottinghamshire intends to award a single call-off contract or two call-off contracts via direct award. The Police and Crime Commissioner will decide upon whether to award a call-off contract for a combination of medical services in custody and sexual offence examination services or separate call-off contracts for these services after receipt of the tenders. The award of the call-off contracts will be made on the basis of the most economically advantageous tender.
For the avoidance of doubt no work is guaranteed under the Framework Agreement.
This Framework Agreement is also intended to allow for innovation.

If a call off contract is awarded under this lot it shall be awarded on the basis of direct award
Provision of medical services in police custody an integrated according to a specific set of requirements arrived at by a force / OCB and which is to be obtained by means of further competition. The initial basis of any service shall be the detailed set of requirements forming part of Lot 1 but these may be modified, amended and added to by a force / OCB as part of any particular Mini Competition. For example the objective criteria for selecting to re-open competition would be on the basis of the particular location of the OCB, the quantity of services the OCB requires and the fact the contract has particularly complex requirements.
Provision of high quality forensic examinations of sexual assault victims according to a specific set of requirements arrived at by a force / OCB and which is to be obtained by means of mini competition.
Provision of a combined high quality medical service in custody and provision of high quality forensic examinations of sexual assault victims according to a specific set of requirements arrived at by a force / OCB and which is to be obtained by means of mini competition
Tenderers will be advised if this is necessary during the procurement process. Parent Company and / or other guarantees of performance or financial stability may be required by the Lead Commissioner if appropriate

In the event of a consortia being successfully appointed to the framework agreement, the Lead Commissioner reserves the right to require the consortia to form a single legal entity or for all consortia members to sign the framework agreement on the basis of joint and several liability.Refer to the Invitation to Tender documentation for further details.
A number of key performance indicators are incorporated as part of the framework agreement
Information and formalities necessary for evaluating if requirements are met: Any supplier may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contract authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal organization, as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council Joint Action 98/742/JHA3 respectively; (j)has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(j) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention of the use of the financial system for the purpose of money laundering.
(a) appropriate statements from banks or, where appropriate, evidence of relevant professional risk indemnity insurance;
(b) the presentation of balance-sheets or extracts from the balance-sheets, where publication of the balance-sheet is required under the law of the country in which the economic operator is established;
(c) a statement of the undertaking’s overall turnover and, where appropriate, of turnover in the area covered by the contract for a maximum of the last three financial years available, depending on the date on which the undertaking was set up or the economic operator started trading, as far as the information of these turnovers is available.
