DS144-15 Supply and Retrofit of Auxiliary Batteries
The Authority is seeking to appoint a Contractor to supply and retrofit auxiliary batteries to a number of their operational vehicles. The auxiliary batteries are required to support the communication equipment.
Potential Providers are able to bid for this requirement based on the following options:
• Option 1 – The auxiliary battery retrofits are carried out at the Contractors Premises (requiring the Contractor to collect and deliver the Vehicles and have their own (or access to) suitable Premises to carry out the Service).
• Option 2 – The auxiliary battery retrofits are carried out at the Authority’s Premises.
Potential Providers are able to submit a tender based on being able to deliver both of these options or one option only. The Authority will decide which option to award, once the tender evaluation stage is complete – It will be at the Authority’s discretion as to which option is awarded.
The contract will be awarded to a single Contractor and will only be open and available for the use of Devon and Somerset Fire and Rescue Service. The relatively low value of the Contract and cap of four vehicles that the Authority can release at any one time is considered achievable for all organisation sizes (including Small and Medium Enterprises).
The contract is anticipated to commence in June 2016.

The contract will be for the supply and retrofit of auxiliary batteries to Medium Rescue Pumping Appliances (MRP‘s) and may include a second optional phase of retrofits to Special Vehicles (Prime Movers, Rescue Tenders, Water Carriers, Operational Support vehicles etc.).
DSFRS currently has 110 MRP‘s and 48 Special Vehicles within its fleet of vehicles (including national resilience vehicles). DSFRS does not intend to retrofit auxiliary batteries to all MRP‘s, only those with a remaining operational life that justifies the investment. Although not confirmed, it is likely that a minimum of 40 MRP‘s will require retrofitting. At this early stage, it is not known how many Special Vehicles would be retrofitted if DSFRS proceeded with the second optional phase.
To maintain operational resilience, the Authority will only release four vehicles for retrofit at any one time.
Optional second phase - A second optional phase to supply and retrofit auxiliary batteries to Special Vehicles has been included within the scope of this contract. At this stage, no funding has been identified for this phase and it is not known how many Special Vehicles would be retrofitted if DSFRS proceeded with it.
Option to extend the contract - The Authority proposes to enter into the contract for a period of two years with the Contractor. The Authority may extend the contract for a further period or periods not exceeding a total contract period of four years.
Minimum insurance levels:
Employers (Compulsory) Liability - £5,000,000 (five million pounds)
Public Liability* - £5,000,000 (five million pounds)
Products Liability* - £5,000,000 (five million pounds)
*Public Liability/Products Liability shall include cover for the following:
1) Property/Vehicles being worked upon
2) Hot work (if applicable)
and should include cover for the following:
3) Advice, design and specification liability provided as part of a package for supply and installation of products
4) Financial loss
5) Failure to perform (efficacy)
Potential providers who do not have in place (or cannot commit to obtain prior to the commencement of the contract) the desirable cover within their Public Liability/Products Liability insurance (those listed as 3), 4) and 5) above), shall have separate Professional Indemnity insurance. In this instance the level of Professional Indemnity insurance required is a limit of indemnity of not less than £1,000,000 (one million pounds) for each individual claim or £5,000,000 (five million pounds) in aggregate.

Organisations wishing to bid as either a consortium or subcontracting arrangement do not require a specific legal form in order to submit a tender. If the potential provider is a consortium, each member of the consortium will be jointly and severally liable for performance of the contract or shall select from amongst themselves a lead partner for the purposes of the procurement. All correspondence in relation to this procurement will be sent to the Lead Partner only.
Economic operators must be registered with the appropriate trade or professional register(s) in the EU member state where it is established (as set out in Annex XI of directive 2014/24/EU) under the conditions laid down by that member state).
Potential Providers will be assessed in accordance with Section 5 of Chapter 2 of the Public Contracts Regulations 2015 on the basis of information provided in response to the Invitation to Tender. Completed responses to the Invitation to Tender must be returned via the e-tendering portal before the deadline for receipt of responses as notified in Section IV.3.4 of this OJEU Notice.
The Authority will review a range of economic information to evaluate your organisation‘s economic and financial standing. In addition to the requested financial information in the Invitation to Tender, the Authority may consult Experian reports and other credit rating or equivalent reports depending on where your organisation is located. In particular, the Authority will consider financial strength and risk of business failure.
If your organisation is evaluated as high risk the Authority may:
— ask for additional information, including information relating to your parent company, if applicable; and/or
— require a parent company guarantee or a performance bond.
