Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive
  • Additional deliveries by the original supplier ordered under the strict conditions stated in the directive
Explanation
The COVID-19 outbreak has given rise to an urgent need for the supply of Patient Monitoring/Assistive technology solution because of reduced staffing capacity and increased patients with physical needs. This does not give Midland Partnership NHS foundation Trust sufficient time to comply with the standard open procedure timescales for this procurement. Midland Partnership NHS foundation Trust considers this to be a state of urgency which it has duly substantiated. Accordingly, Midland Partnership NHS foundation Trust is using the provisions under the Public Contract Regulations 2015 (regulation 32) in respect of this procurement.
