Devon and Somerset Fire and Rescue Service (on behalf of the Chief Fire Officers Association (CFOA) Transport Officers Group) is leading a procurement project to implement a Framework Agreement, specifically for the United Kingdom Fire Sector, for Emergency Response Vehicles (Pumping Appliances, Aerial Appliances and Special Vehicles).
The Framework Agreement contains multiple lots, some of which are multiple supplier lots (lots 1, 2, 3, 4, 6, 7, 8 and 9) and others single supplier lots (lots 5a, 5b and 10).
The target date for the Framework Agreement to go live is March/April 2017.
Full details of the requirement is provided in the tender documents, which are available to all suppliers via the link provided within section I.3)

For the purpose of this Framework Agreement, Special Vehicles are identified as Fire and Rescue Emergency Response Vehicles, which are 3 tonne or over (GVW) and are not an Aerial or Pumping Appliance. Examples of Special Vehicles include (but are not limited to) Specialist Rescue Units, Off Road Vehicles, Water/Foam Carriers, Prime Movers, Hose Layers, Incident Support Units, Incident Response Units, Incident Command Units and General Purpose Vehicles (box lorries e.g. Environmental Protection Units).
Term of the Framework Agreement:
The Authority proposes to enter into the Framework Agreement for different periods for the multiple and single supplier lots:
Multiple supplier lots - A period of four years with the Framework Contractors. The Authority may extend the Framework Agreement for a further period or periods not exceeding eight years in total. It is anticipated that any extensions would be in 24 month periods.
Single supplier lots – A period of six years with the Framework Contractor/s, with no extensions.
The Public Contract Regulations stipulate the following in relation to the term of a Framework Agreement - ‘The term of a framework agreement shall not exceed four years, save in exceptional cases duly justified, in particular by the subject-matter of the framework agreement’.
The extension of the Framework Agreement (for the multiple supplier lots) beyond four years shall be at the Authority’s discretion. Justification for extension would need to meet the following criteria:
• The Framework Agreement still meets the requirements of the Contracting Authorities, and
• The Framework Agreement is not acting as a barrier to any new suppliers in the market, or any who were not successful in winning a place on the Framework Agreement
The justification for the single supplier lots to be six years is to enable Devon and Somerset Fire and Rescue Service contingency time for the full rollout of Rapid Intervention Vehicles and Incident Support Units of the same core design and to allow for unforeseen political or strategic change which has a direct impact on the project.
Contracting Authorities:

• All Fire and Rescue Services (FRS) within the United Kingdom – See below for a list of these FRSs.
