United Utilities has a requirement to carry out inspections of reservoirs under section 10(2)(d) of the Reservoirs Act 1975, as amended by the Flood and Water Management Act 2010. Inspecting engineers are appointed to the Panel by DEFRA and monitored by the EA. Since the requirement is legal, rather than regulatory, OFWAT have no involvement.

Lot 1 Inspecting Engineer Each Panel Engineer that UU appoints carries out an independent inspection in accordance with the Act and issues a Section 10 report with any recommendations to the Undertaker (UU in this case) and copies it to the Enforcement Authority.
Lot 2 Qualified Civil Engineers (QCE) The QCE shall give advice to the Company, as the reservoir undertaker, about the safety of the dam during and after construction until the works are certificated or otherwise signed off. This will include the approval of any contingency plans to deal with flood/seismic activity/stability events etc., before and during construction until sign off.
